Illegal aliens from twenty nations are being protected from deportation by Temporary Protected Status [TPS] or Deferred Enforcement Departure [DED] status. These designation are initiated for 18 months, but can be extended an unlimited number of times. Note that each time illegal aliens from a certain country are granted TPS, there are various nuances. It does not necessarily apply to all illegal aliens from that country, and does not necessarily apply to new illegal aliens.
However, the US federal government is using TPS and DED as a tactic to circumvent Congress and defy the wishes of the American public by creating defacto amnesties or even defacto open borders. These illegal aliens are allowed to hold jobs, get driver’s licenses, and receive welfare, food stamps, subsidized housing, and more.
George Bush first granted illegal aliens from El Salvador TPS in 2001 citing an earthquake. Far from being “temporary,” it has been extended for over two decades now. Secretary of Homeland Security Alejandro Mayorkas just announced that it was being extended again due to “bad weather” in El Salvador. This TPS currently applies to about 234k illegal aliens.
George HW Bush granted illegal aliens from Liberia TPS status in 1991. Far from being permanent, this was extended for over three decades. Obama then expanded it by granting DED status to recent Liberian illegal aliens on September 28, 2012. The original TPS order was allowed to expire in 2024, but only because Obama’s more recent DED status covers all the same people anyway.
The Trump administration declined to renew TPS status for six countries. However, radical activist federal judges intervened and obstructed Trump to keep this active. TPS for Haiti was the only one that officially ended under Trump. However, the Supreme Court overturned efforts by lower courts to obstruct Trump in late 2020. However, Haiti is the only country where TPS was officially ended under Trump. Biden immediately reversed Trump’s orders to allow TPS to expire for the other five countries. Biden regranted TPS to illegal aliens from Haiti.
