In 1991, Tennessee passed a law making prostitution a more serious crime if the person knows that they have HIV/AIDS. Instead of only a misdemeanor, a person can be charged with felony aggravated prostitution. The Biden Administration is now suing the state, claiming the law discriminates against the “disabled.”
The effort is being spearheaded by Kristen Clarke, Assistant Attorney General for the Justice Department’s Civil Rights Division.
